These Terms of Service ("Agreement") govern your use of the services, content, and functionality offered by Jude AI, Inc. ("Jude AI", "we", "us", "our") through our website, software, applications, and other platforms (collectively, "Services").
1. User Content
You are solely responsible for any content, including real estate content, that you or any other user or third party post, send, or otherwise make available over the Services ("User Content"). You agree that we are only acting as a passive conduit for your online distribution and publication of your User Content. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate, or otherwise unsuited to your purpose, including but not limited to real estate content.
2. Disclaimers and Limitations of Liability
Jude AI is not responsible for and does not endorse any User Content submitted to the Services. We do not have any obligation to prescreen, monitor, edit, or remove any User Content. If your use of the Services or User Content results in the need for servicing or replacing equipment or data, we are not responsible for those costs.
Under no circumstances will Jude AI be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or in connection with your use of the Services or User Content, whether or not Jude AI has been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.
You agree that Jude AI shall not be liable for any damages you allege to incur as a result of or relating to any User Content.
3. Proprietary Rights
All intellectual property rights related to our Services and the content we provide (excluding User Content), are the exclusive property of Jude AI and its licensors. You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any Jude AI content. Use of the Jude AI content for any purpose not expressly permitted by this Agreement is strictly prohibited.
4. Feedback
You may choose to or we may invite you to submit comments, suggestions, or ideas about our Services, including how to improve the Services or our products (“Feedback”). By submitting any Feedback, you agree that your disclosure is gratuitous, unsolicited, and without restriction. You agree that Jude AI is free to use the Feedback without any additional compensation to you, and/or to disclose the Feedback on a non-confidential basis or otherwise to anyone.
5. Digital Millennium Copyright Act (DMCA)
We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act, we will respond promptly to claims of copyright infringement committed using our Services that are reported to us.
6. Acceptable Use Policy
(i) transmit or post any content that is abusive, harassing, threatening, defamatory, obscene, fraudulent, deceptive, misleading,offensive, pornographic, illegal, or unlawful;
(ii) harm or exploit any person, especially minors, in any way;
(iii) violate any law, statute, ordinance, or regulation;
(iv) infringe or violate the intellectual property rights, contractual rights, or any other rights of anyone else;
(v) post or submit any false, misleading, deceptive, or fraudulent content;
(vi) attempt to impersonate another person or entity;
(vii) distribute viruses, spyware, corrupted files, or any other similar software or programs that may damage the operation of any computer hardware or software;
(viii) make any automated use of the Services; or
(ix) use the Services in a manner that overburdens, disrupts, or harms the Services or our systems or networks.
7. Modification of Terms
Jude AI reserves the right to change, modify, add, or remove portions of these Terms of Service at any time. It is your responsibility to check these Terms of Service periodically for changes. Your continued use of the Services following the posting of changes will mean that you accept and agree to the changes.
8. Account Use
You are responsible and liable for all uses of the Services resulting from access provided by you, directly or indirectly. You are responsible for all acts and omissions of users accessing the Services with your account. You shall use reasonable efforts to make all users aware of this Agreement’s provisions.
9. Passwords and Access Credentials
You are responsible for keeping your passwords and access credentials associated with the Services confidential. You will not sell or transfer them to any other person or entity. You will promptly notify us about any unauthorized access to your passwords or access credentials.
10. Third-Party Products
The Services may permit access to products, services, websites, advertisements, and content from advertisers, vendors, and other third parties (“Third-Party Content”). Your use of Third-Party Content may be governed by the terms and conditions of that third party. We do not control, endorse, or assume any responsibility for Third-Party Content and can make no guarantee as to its accuracy or completeness.
